Oracle flags a payment pause if its New Mexico AI campus slips

Oracle has filed a force majeure notice on the Project Jupiter Stargate site, citing events outside its control.

Force majeure clauses are routine in energy contracts and rare in data centre deals. Oracle has filed one on Project Jupiter, the Stargate campus it anchors in New Mexico, Bloomberg reported. The notice does not mean Oracle is leaving as the site’s main tenant. It would let the company pause payments if the campus misses its 2028 target to switch on.

Both sides said the schedule holds. Oracle told CNBC the project remained on its planned schedule and that it was fully committed to New Mexico. Blue Owl Capital, whose unit received the notice, said the multi-year financial commitments were unchanged.

Power is the weak link, and fuel is why. The campus is designed to draw 2.45 gigawatts, supplied by gas-powered fuel cells from Bloom Energy, so gas delivery drives the timeline. An Energy Transfer pipeline serving it has slipped nearly six months to February 1, 2027, after regulators rejected permits repeatedly, and its route was redrawn in August. One more approval is outstanding: an air-quality permit for the fuel cell system, which the state environment department must decide by November 23.

Stargate is the infrastructure push Oracle, OpenAI and SoftBank launched with President Donald Trump, and the site is one of its flagships. Residents and environmental groups have fought it, making it a political flashpoint as well as a test of whether AI buildouts can clear the power and permitting chain behind them.
